This Privacy Policy applies to all personal data collected by 60seconds Pty Ltd ACN 167 715 540 (“60seconds”, “we”, “us” or “our”) via the 60seconds website made available at https://60seconds.com/ together with our Apple and Google applications (together referred to as the Application).
The purpose of this Privacy Policy is to inform you how we collect and use any personal data about you. The Privacy Policy may be varied from time to time. You should check our Application regularly to take notice of any changes we may have made to the Privacy Policy.
1) Controller
60seconds is the data controller and responsible for the processing of your personal data in connection with the access and use of the Application.

2) When do we collect personal data about you?
We collect your personal data when you log on to and/or use the Application or contact us via email or post in connection with your access and use of the Application.
3) What personal data do we collect about you?
We only collect personal data that is relevant for the purposes of running and administering the Application. This may include:
(a) Your name, job title, work contact number(s) and email address
(b) Photograph(s) of you
(c) Video and audio recordings of you
(d) Your IP address used to log into the Application
(e) Notes from our face-to-face, video or telephone meetings with you
(f) Any other data that you provide
We also collect cookies from the device you use to access the Application which enable us to tell when you use the Application and also to helps customise your Application experience. As a general rule, however, it is not possible to identify you personally from our use of cookies. (For your information: most web browsers are set to accept cookies by default. If you prefer, you can usually remove or reject browser cookies through the settings on your browser or device. Keep in mind, though, that removing or rejecting cookies could affect the availability and functionality of the Application.)
4) How do we use your personal data?
The personal data we collect from you will be used to provide you with the best service experience possible on the Application such as for the purpose of enabling staff to review and feedback on presentations from other staff.
We will only use your personal data:
(a) where necessary for the purposes of the legitimate interest of 60seconds specifically, 60seconds’ legitimate interest in providing the Application, training its workforce and helping improve performance of the Application; or
(b) where it is necessary for the performance of a contract which you have entered into with us; or
(c) if required to satisfy any applicable law, legal requirement, police investigation or request from a government authority. Your personal data may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties; or
(d) with your consent. By using the Application, you acknowledge and agree that you have read and understood this Privacy Policy and consent to the use of your personal data as set out in this Privacy Policy. If you do not agree with this Privacy Policy, you may withdraw or vary your consent on the Application or contacting us as set out below; or
By using our Application, you consent to the receipt of direct marketing material. We will only use your personal data for this purpose if we have collected such information directly from you, and if it is material of a type which you would reasonably expect to receive from us. We do not use sensitive personal data in direct marketing activity. Our direct marketing material will include a simple means by which you can withdraw your consent by requesting not to receive further communications of this nature.
5) How long we keep your personal data
All personal data will held by 60seconds for the period necessary to fulfil the purposes outlined in this Privacy Policy.
We will retain some of your personal data after you cease using the Application if reasonably necessary to satisfy any applicable law, legal requirement, police investigation or request from a Government authority.
6) Your Rights
You have rights in respect of your personal data which is collected and processed in connection with the access and use of the Application.
You have the right to request access to your personal data, a copy of your personal data and to request that we correct any inaccurate personal data.
You also have the right to request that we not sell, release, disclose or transfer your personal data. In some circumstances, you may also restrict or object to the processing of your personal data.
You may delete any personal data you upload to the Application. You may also request the deletion of your personal data.

7) Security
We process personal data on our servers in Australia, and you consent to your personal data being processed and stored in that location.
We acknowledge that we will take appropriate security measures to protect against unauthorised access to or unauthorised alteration, disclosure or destruction of your personal data. These measures may include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorised access to systems where we store personal data.
We do not warrant that these security measures will prevent any unauthorised access to or unauthorised alteration, disclosure or destruction of the data. We disclaim all liability in relation to any unauthorised access, alteration, disclosure or destruction of data that is outside our reasonable control.
We will notify you within 72 hours and without undue delay of any:
(a) actual breach of security, which when reasonably suspected poses a risk to the security, confidentiality or integrity of your personal data; or
(b) actual unauthorised access of any personal data;
which is likely to result in a high risk to your rights and freedoms.
8) Complaint procedure
If you have a complaint concerning the manner in which we maintain the privacy of your personal data, please contact us as set out below. We may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.
9) Who do we share your data with?
In using the Application, your personal data may be shared with:
(a) other users of the Application; or
(b) third parties including our service providers who provides and administers the Application.
The recipients may be located in Australia or overseas. 60Seconds Pty Ltd is based in Australia. Whilst Australia has a data protection supervisory authority and data subject rights, Australia is not one of the few countries which is the subject of an adequacy decision by the European Commission.
While we endeavor to ensure that your personal data is adequately protected, the overseas recipient may have laws which are different and potentially not as protective as the laws of your own country. In the circumstances, we will assess the technical and organisational measures our processors have in place and will maintain when operating the Application to satisfy ourself that your personal data is protected in such circumstances. In addition, where appropriate, 60seconds will endeavour to enter into standard contractual clauses with the processors to act as a further safeguard for your personal data being transferred outside of Australia. We will not be liable for any mishandling of your information in such circumstances.

11) Governing law
This Privacy Policy and any contract to which they apply shall be governed by the laws of New South Wales and are subject to the jurisdiction of the courts of New South Wales.
